Sexual harassment of women at workplace, According to the Constitution of India it has been considered as the infringement of the women’s right to equality, life and liberty. It creates an insecure work environment, which discourage women’s participation

 in work, thereby adversely affecting their social and economic empowerment and goals of the inclusive growth. When sexism and discrimination term gone old as human race the new term was coined up as “Sexual Harassment” in mid 70s by Lin Farley. In the late nineteenth and the early twentieth century, all the surviving accounts of  women’s in the positions of manufacturing , laboring , etc. were also have to deal with these kinds of situations in which higher ranks/positions of  male employees were harassed the women employees through verbal abuses, imposed the sexual relationship with their women’s employees who were worked for them and with them, and also they  were ragged all types of unwanted physical abuses with the women employees. In our country, India the issue of sexual Harassment with women’s has been always overlooked by the family members of that women, they didn’t want to do file the complaint against the employee who harassed his daughter, wife of any other family member because of that “ so-called” society in which they live, only to maintain the reputation in that society they didn’t complaint against them, due to that some of the women try to commit suicide because they don’t able to take too much pressure of that raging which she were regularly facing in her company, or any other place in which she works.  

Impact of sexual harassment with women’s were felt only beyond the harassing interaction. Around all over the world there are no sector remain untouched in which sexual harassment had not been done with the women’s. Sexual Harassment mainly done with those women’s who want to take promotions very suddenly without doing any kind of hard work towards that firm. And also with those women’ s who came from backward areas for earning money on which the whole family are depend , higher officials gave the threat to that women  if she can’t sleep with them then they will fire her from that job so only because of the family pressure she will have to do that with their higher officials.

There are many kind of ways by which a women has been harassed in her office , such ways are also comes under the definition of sexual harassment as defined by the Supreme court of India as follows:-

• Physical Contact with her

• Sexually colored remarks 

• Showing Pornography to her

• Higher officials demands sexual favor with their women employees in respond of promotion.

• Any other verbal or non-verbal conduct that is sexual in nature.

• Any rumors at workplace of women with sexually colored remarks.

• Spreading rumors about a women’s sexual relationship with anybody by which a women feel humiliating.

Reality

Now the Today’s reality are that, In spite of the strong law and increased awareness about women’s rights posts 2012 Delhi gang Rape case, approx 70% of women in our country has been faces the problem of sexual harassment in their working areas and they were didn’t file any complaints to the any govt. platform, that survey was conducted by Indian Bar Association in 2017.  A research were conducted by the Federation of Indian Chamber Commerce and Industry(FICCI) in 2015 showed that 36% Indian companies and 25% of Multinational companies don’t have the internal complaint committee (ICC) , due to which woman is not able to file the complaint if she were harassed by the any male employees. According to  the rules and regulations if any organization have 10 more than that employees it is mandatory to have ICC in as per the Sexual Harassment Act, 2013.

Silence

Most of women’s didn’t want to share all these problem to anyone because they were know that their were the lack of support from their male colleagues and with the women colleagues during the legal proceedings in the court rooms and the second or the most imp. reason was choosing that long frustrating judicial system I which my of the questions ask with them which she didn’t want to remember again in her mind or life. And if a women sued someone it will become came in public legal records everyone is able to read the  whole case of that women , and our “so-called” society taken that girl in the wrong sense, the life of that women gone be public , these legal proceedings creates more hurdles I the future because no one want to hire that employee who sued someone in her past and also have the legal background. At the last but not the least due to lack of information and awareness of it will make difficult to file the complaint or that such report as they don’t know where to file them.

In the last couple of years the cases those were related to sexual harassment have rapidly increased and covered by the Indian media . Now that’s the time in which women’s must have to feel safe and secure, the employeers must have to take the affirmative steps threw which women feel safe and secure in his working place by making the zero-tolerance policies towards the sexual harassment and ensure that all the investigation has been made regarding the sexual harassment with the women make very confidential.

Many of the sexually harassed victims are very shy from the publicity, the judicial process of our country is also very harsh to get the justice, the govt. need to make an alternative structure which deals with the all these types of cases. We need to help the victims to make her more inform about all the acts and laws which were already made it up by the govt. At last but not the least it is not compulsory for the victim that she will used her own real name in the complaint, the complaint also be file with the fake name because if the name has been published by the media then that case doesn’t affect the life of that victim, and all the trial sessions must have been recorded with the help of the cameras.

We must stand firm against such culprits. If we are not going to stop them this will make them do that crime again and again.
