Preamble is like a summary or introduction of Indian constitution which contains the basic philosophy and objectives of Indian constitution. it reflects the mind of constitution makers.
Pandit jawaharlal Nehru drafted and moved a resolution called “Aims and Resolution” Which shape the constitution of India. In the end, this resolution was modified and adopted as preamble. It looks like the Declaration of Independence of America.
The text of preamble tells us very important information: -
(1) “WE THE PEOPLE”
This word signifies that the people of India are the source of authority for the constitution. they had drafted, adopted and given to themselves this constitution. The word “we the people” Also signify that this constitution belongs to each and every citizen without any exception.
(2) Sovereign, socialist, secular, democratic, Republic- These five words tell us about the nature or features of Indian state.
· Here, the word SOVEREIGN- Means India is a politically independent state which gives India the power to formulate it's domestic and foreign policy without any external interference. Sovereignty as a modern concept has its origin in “Treaty of Westphalia” Where states( country) Agreed to not interfere in each others internal matters .
· The word SOCIALIST- Socialism is a system where state controls the factors of production like land, capital, technology, labor etc. The government demonetize the market as against forces of demand and supply. there are taxes on rich and subsidies on poor.
India practices democratic socialism and mixed economy where public sector and private business co-exist.
(3) The objectives of India constitution are: -
· JUSTICE-In the form of social, economic and political justice.
· LIBERTY- Liberty of thought, expression, belief, Faith and worship.
· EQUALITY- Equality of status and opportunity.
(4) Fraternity and dignity of individuals – the feeling of brotherhood and tell us about that our constitution assures the dignity of the individual.
(5) Unity and integrity of the nation.
There Are many questions in the mind of people regarding preamble
1- Is preamble a part of constitution or out of the constitution?
So let me tell you…, Supreme Court in kasavnanda bharti case 1973 held that preamble is a part of constitution but preamble is not counted as one of the 25 parts.
2- is preamble and its value justiciable or enforceable?
Preamble and its values are not enforceable by court therefore, they are non justifiable in nature. preamble does not act as restrictions on powers of state or source of power for state. However, preamble assist Indian judiciary in interpretation of constitution.
3- Is preamble Amendable?
Yes, it can be amended but it's amendment means enrichment of already given values but not curtail anyone given values. So far, preamble is amended has one time in 1976 which added three new words- Socialist, secular and Integrity.
