What is cyber crime? 

Cybercrime, also called computer crime, the use of a computer as an instrument to further illegal ends, such as committing fraud, trafficking in child pornography and intellectual property, stealing identities, or violating privacy

                    Their are number of crime increasing all over the world but cyber crime has its own roots and drawbacks. As we all know that due to increasing technology our life has become a bit easy, but its curses has ruined our life as well. One of the best example of this is cybercrime. Their are many types of cyber crime Types of cyber crime? 

1) Financial fraud crimes

2) Cyberterrorism

3) Cyberextortion

4) Cybersex trafficking

5) Cyberwarefere

6) crime against women 

                            One of the heinous type of crime done by cyber is of against women .Though crime against women is on a rise in all fields being a victim of cybercrime could be most traumatic experience for a woman. Especially in India where the society looks down upon the women, and the law doesn’t even properly recognise cybercrimes. In this blog I plan to discuss upon the various types of cybercrimes that can be inflicted upon a women and how they adversely affect her. I shall also briefly examine upon the various laws that exist to protect women in such cases such as the Information Technology Act (2000) and the new laws that are coming upon in this field such as the Criminal Amendment Bill (2013). I will be taking assistance of various cases reputed cases (eg: Ritu Kohli case) in cybercrime to arrive at our conclusion. We are also having an elaborate review upon the recent increase in cybercrime on women and its various causes . Lets discuss about the ritu kohli case for more legal help and solution. 

Ritu Kohli’s case is the first case in India dealing with cyber stalking. The case in which issues were raised as to what is cyber stalking? Why don’t’ we have laws regarding it?  Recently, the Delhi Police arrested Manish Kathuria the culprit of the case. In the said case, Manish was stalking a person called Ritu Kohli on the Net by illegally chatting on the website http://www.mirc.com with the name of Ritu Kohli. Manish was regularly chatting under the identity of Ritu Kohli on the said Website, using obscene and obnoxious language, was distributing her residence telephone number and inviting chatter to chat with her on telephone.Consequently Ritu Kohli was getting obscene calls from different chatters from various parts of India and abroad. Ritu Kohli reported the matter to the police and the Delhi Police swung into action. The police had registered the case under Section 509 of the Indian Penal Code for outraging the modesty of Ritu Kohli.  But Section 509 of the Indian Penal Code only refers to word, gesture or act intended to insult modest of a woman. But when same things are done on internet, then there is no mention about it in the said section. None of the conditions mentioned in the section cover cyber stalking. Ritu Kolhi’s case was an alarm to the Government, to make laws regarding the aforesaid crime and regarding protection of victims under the same.

As a result Section 66A of the Information Technology Act, 2008 (ITAA 2008) states, “Punishment for sending offensive messages through communication service, etc:

Any person who sends, by means of a computer resource or a communication device,-

(a) any  information that is grossly offensive or has menacing character; or

b) any  information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, or ill will, persistently makes by making use of such computer resource or a communication device,

(c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages (Inserted vide ITAA 2008) shall be punishable with imprisonment for a term which may extend to three years and with fine

      As this case shows that initially there was no law for crimes against women but after the landmark judgement of ritu kohli case there is finally is law for this type of crime. 

OUR OPINION:-

According to us cyber crime is as very rapidly growing crime and it is affecting the lives of many youngsters and even childrens so we believe that everybody should be aware of this crime and should know how they can protect themselves from such crimes because it is not only government's but also every citizen's duty to stop this kinda crimes Government has already done incredible job by making  law but government should also ensure proper implementation of this law because we have seen in many cases that laws hasn't properly executed and it costs lifes of many peoples.We all know that social media is a biggest platform for interaction but interaction with someone you dont know can really make things worst for you. So it is better that everyone not only govt but also citizen can help to uproot this crime.

b. Awareness programs

c. Social media control 

d. Rules for using social media platform

e. Proper help if someone gets into trouble

f. Helpline number for reporting such crimes

We believe that this solutions can really help for uprooting this crime...
