What is Reservation?

Reservation is a quota of reserved number of seats not only in the education system but also in government occupations and different facilities for the backward classes. Originally there was a vision system, the earliest reports are found in the Kolhapur dynasty in 1902 in which the non-brahmin people, lower caste people were given reservation in government jobs as well as in the education system. 

Now, if we specifically talk about the education system and the reservation for education, in the Constitution originally there was reservation only based on the quota given in the government legislature and that too only for ten years. There was such concept of OBC, or the Economically weaker sections. Under the amendment under article 15(4) and article 16(4) were added to which provided reservation to other communities for an extended period of tie. As of now,  in the education institution the reservation that is present has no validity. In 1992, the OBC bill or the Other Backward Class bill was passed by the parliament which gave reservations to communities under OBC. In 2019, the economically weaker section of the society bill was passed which provided reservation to the EWS section or the Economically weaker section of the society. 

In India, 33% of the seats are to be reserved in the parliament but this bill has never been passed. One third of the seats in the panchayat are available to the women population as of now. OBC's take up almost 27% of the reservations. SC and ST's make up around 15-16 % of the reserved population. Now, after the induction of the EWS which added another 10%, and when you total all of the this, the reservation now is almost 59.5%. The review under a statement by the supreme court n 1991 it was stated that reservation cannot breach the 50% gap. Which as of now is breached in many of the states. The government is of the view that EWS does not come under the caste status and that is why it cannot be impacted by the 50% cap. 

As of now only 40% seats are preserved for the general candidates to compete on. And on these 40% also the general candidate does not get to compete it is also the candidates from the EWS, SC, ST and OBC who also compete for the very same seats. If a person takes the advantage of SC and ST reservation then the same reservation would be passed on to the next generation but it is not so. In OBC in which the non-creamy layer concept  comes into play which provides the financial condition of the family into consideration. In the end i would like to say that reservation is something which was initiated in terms to help people who genuinely had opportunity issues, it was something which was thought or for only 10 years but it is 75 years now, which is not reducing but increasing day by day. 50% cap should be respected by all the states and the center and should no be breached under any circumstances.
