Candlemonk values and respects the intellectual property rights of others and strives to offer a platform that doesn’t house or host any content in any form that is in violation of those rights. Candlemonk’s terms of use requires that content and information posted or published in any form (text, image, etc.) be their own and not in violation of the rights of any other party.

If your intellectual property rights are violated by any user of Candlemonk, you can submit your complaint regarding the same by following the procedure explained below.

Be aware that whether the reported content is removed or not, Candlemonk might share the reported details, including the reporter’s contact particulars with the user who posted or published the content and/or take other necessary measures to let the publisher know Candlemonk received a report that the content they had published has been claimed to be violating the intellectual property rights of others.

Any notice or counter-notice you submit must be submitted under penalty of perjury. Give a good thought and be well informed before you submit a claim or counter-notice. A false claim or counter-notice may lead to legal consequences and financial liability. Seek the advice of a legal counsel before proceeding with your submissions.

To report your copyright infringement, provide us the following information:

  1. A physical or electronic signature (typing full name will do) of the copyright owner or a person authorized to act on their behalf;
  2. A description of the copyrighted content that you allege has been infringed (e.g., a link to your original work allegedly being infringed upon);
  3. A description specifying the location of the content that you claim is infringing on our website  or platform(e.g., an URL Link to the page containing the content) ;
  4. Your contact details, including your phone number, address and your email address;
  5. A statement that you have a good faith belief that the use of the material in the manner asserted is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the complaint is accurate, and, under penalty of perjury, that you the copyright owner or are authorized to act on behalf of the copyright owner.

To file a counter-notice, provide us the following information:

  1. A physical or electronic signature (typing full name will do);
  2. Details of the content that has been removed or to which access has been disabled and the URL link to the page in which the content was part of earlier;
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. Your contact details, including your phone number, address and your email address;
  5. A statement under penalty of perjury, that you the copyright owner or are authorized to act on behalf of the copyright owner (or) A statement that you have a good faith belief that the use of the material in the manner asserted is authorized by the copyright owner, its agent, or the law;

Alternatively you can directly email us the details to contact@candlemonk.com by including the phrase ‘Copyright Infringement’ in your mail’s subject line.

If we decide to remove or disable access to the content based on our analysis of the details submitted, we will notify the affected user and provide them the details of the reporter’s complaint including the provided contact information along with instructions on how to file a counter-notice. We would also acknowledge the reporter’s communication by responding with the decision taken and details on how they can proceed further if they wish to.
