Former motor vehicle Act
Any Machine which generates power and helps in the transportation of individuals and trends by the mode of transport Road.
The Motor Vehicle Act,1988, came into power on 1 July 1989, and the motor vehicle (Amendment) Act, 2019 came into force on 1st September 2019.
The Act appears with components issued by the legislative provision by the Govt. of India, which encompasses drivers/conductor's license, registration of the machine, control of the machine vehicle, special permission of state transport, traffic regulation, and insurance of the vehicle, etc.
The Motor Vehicles (Amendment) Bill, 2019 is established on the proposals of the Group of Transport Ministers of States. Given that the Act wanted to prevent people from disobeying traffic rules, it has inducted heavy fines for drunken driving, driving without a license, hazardous driving, over-speeding, etc. These charges will be increasing by 10 per cent, every year on April 1, as enlightened by the Central government. The modern Act has also prolonged the duration for renewal of driving licenses from one month to one year after the date of expiry. Only if the renewal is halted for more than a year, will the driver have to suffer a test of competence. The Act also pledges to safeguard those individuals who represent emergency medical or non-medical aid to a victim of an accident, from any civil or criminal liability. The radar compensation for death or grievous injury due to hit and run has changed positions substantially.
Why is it vital?
In 2017, as per data by the Ministry of Road Transport and Highways, there had occurred 4.64 lakh casualties that contended the lives of 1.47 lakh people. Two-wheelers accounted for over a third of all road emergencies. Slowly, as all States proceed executing the provisions of the Act with bigger fines and imprisonment for drunk driving, driving without license and insurance, and juvenile offences, civilization may begin to obey rules, and road accidents may decrease. Legal motor insurance is vital so that the aggrieved parties in a road accident get compensation.
However, State governments are unrestricted to give rise to their laws and rules.
Significance of Motor Vehicle Act
Conclusion:
The Motor Vehicles (Amendment) Bill, 2019 brought in considerable modifications to the Former Act (i.e., 1988 Act) comprising modifications like excluding the theory of ‘No fault’ liability in cases where accidents led to death or permanent disablement. It also replaced the terms of punishment under Chapter XIII that deals with offences and penalties, with higher verdicts and fines.
