We read or hear many legal term from news paper, media or group discussion.Sometimes we don't get the exact meaning of those worlds.So in this blog, we will try to know meaning of some terms we use in day to day life.
1.Law -:
This term has been defined by many scholar from all around the world. In one case ,our Indian Judiciary defined it as, “ any ordinance, order by law, regulation, notification, custom or usage having in the territory the force of law.”
2.Person-:
According to one scholar, “ a person is any being whom the law regards as capable of rights or duties, whether a human being or not”. Person are of two kinds - 1) natural and 2) legal e.g a corporation.
Under Indian Penal Code ,1860, definition of person covers company, association of body of a person whether incorporate or not.
3.Suit -:
Any legal proceeding of a civil nature brought by one person against another is termed as a suit. It contains the cause of action and circumstance took place to take such action. There must at least one plaintiff and one defendant in suit.
4.Facts -:
Facts means a narration of events , acts, things done which shows legal liability of the defendant to the plaintiff, an actual happening in time or space or an event actual or physical
5.Issue-:
Issue is point of which the debate is based in the court of law. The issue can be of law or facts or both.
6.Plaint -:
Plaint is a statement in writing, consisting of the cause of action and the relief claim. All civil suits are instituted by the presentation of plaint in civil court.
7.Ex - Parte Decree -:
If plaintiff appears in court for hearing but the defendant fails to appear for hearing even though the summons served for the same, the court may pass a decree on the defendant after hearing the suit ex-part ,i.e in the absence of opponent.
8. Complaint -:
Any allegation made orally or in writing to a magistrate for taking action under Criminal Procedural Code against some know or unknown person is complaint. Allegation in criminal case is called complaint and in civil case is called as plaint.
9. Bail -:
It is procedure of releasing a person from legal custody with undertaking by that person that he/ she shall appear at the time and place designated, and submit himself/ herself to the jurisdiction of the court.
10. Injunction-:
It is a judicial process by which party apply to do or refrain from doing some act because he fears possible future injury.There are two types of injunction -1) temporary and 2) perpetual.
