The United States police have been under constant scrutiny by citizens about their actions and integrity. According to statistics, police officers commit crimes at an alarming rate. As of April 2017, the American Police Beat Index (APBI) revealed that police officers in America were committing crimes at the highest rate since 2009. In fact, many cities across the country had an increase in reported crime, especially those in impoverished neighborhoods.
Many officers who were involved in misconduct were not even held accountable by their employers. When conducting research based on the APBI data, it was discovered that police-related arrests have increased significantly over the past 10 years. A total of 2,846 officers were arrested between 2008 and 2012. By comparison, 4,942 officers were arrested between 2013 and 2016.
Of course, this cannot be solely attributed to officer misconduct alone; however, it does show how pervasive police corruption is in some communities across the nation.
Police Community:
In order to provide accountability and trustworthiness among law enforcement agencies and personnel, Congress passed the Law Enforcement Officers’ Bill of Rights Act (LEOBRA). LEOBRA was designed to give civilian oversight of the police officers and create standards for officer conduct. LEOBRA provides guidelines for hiring and training police officers, promoting professionalism among police departments, protecting civil liberties of civilians, and providing compensation to victims of police violence.
However, LEOBRA did not address issues of officer misconduct. Rather than focusing on accountability, LEOBRA focused on job protection for law enforcement officers and provided them with extensive legal protections.While these laws may have prevented abuses of power, they failed to guarantee fair trials for officers accused of wrongdoing. Instead, they created a culture of impunity for rogue cops.
Many argue that LEOBRA is ineffective due to its lack of transparency and public involvement. According to a report released by the National Institute for Civil Discourse, police officers routinely abuse their positions of authority and violate citizens’ rights. Furthermore, the report showed that police officers tend to commit crimes that are similar to the offenses committed by members of the general population. Thus, LEOBRA serves only to protect corrupt police officers rather than preventing future violations of law.
Over time, legislation was passed in numerous states that aimed to reform the police system. Most recently, California passed Senate Bill 827 on March 19, 2018. SB 827 aims to strengthen the use-of force policies and procedures in order to prevent excessive force by police officers. This bill also requires the Department of Justice to review all use-of-force cases involving police officers. Additionally, SB 827 requires the Attorney General to release records related to fatal shootings by police officers. Currently, only three states—California, Illinois, and Washington—have adopted measures that mandate independent investigations of alleged police brutality.
Conclusion:
It is clear that the police system is deeply flawed and needs significant overhauling. Until then, police officers should be subject to criminal prosecution, just like any other citizen. Moreover, there needs to be greater transparency and accountability in policing practices and procedures. Finally, the US government should focus on reforming police departments nationwide instead of simply passing new legislation. Without addressing underlying problems, we cannot expect meaningful change in our society.
