These following terms and conditions apply to your use of any of Candlemonk’s services and platforms via any media in any form. By signing up for or using Candlemonk or its services, you consent to agree to all the terms and conditions.
You are solely accountable for your use of the Candlemonk platform, its services and any blog or write-up or content or comment you draft or publish or post. The content you see or read on the platform might be secured by the intellectual property rights of others. Do not reuse any content without the concerned owner’s approval or authorization.
In order to use some or all of Candlemonk’s features and services, you might need to sign up or register for an account with Candlemonk. In order to protect and safeguard your account and activities, do not share your account password with others.
You must be 13 years or older to use the Candlemonk platform. If you’re agreeing to these terms & conditions and are using the platform or services on behalf of any other person or entity, you represent that you’re authorized to do so, and thus the words “you” or “your” in these Terms and Conditions include that other person or entity.
You can choose to deactivate or delete your account with Candlemonk at any time. On the other hand, we may terminate or suspend your account if you violate any of Candlemonk’s terms or policies or for any other reason.
Improving your experience on the Candlemonk platform is of high priority to us. As a measure for the same, we might add or change or remove features and may do so without any notice to you.
We might periodically review your behaviour and content for compliance with these terms, and reserve the right to remove any violating content. Candlemonk reserves the right to delete blogs or write-ups or comments or other content in any form alleged to be infringing others’ intellectual property rights and to terminate the accounts of infringers.
We respond to reports of alleged copyright infringement by taking necessary steps. Please communicate such reports as per the procedure mentioned in the Copyright Policy page.
Candlemonk allows you submit information about yourself and publish your blogs or write-ups that contain texts, images, videos, links and other forms of media. All information or data or content that you provide or post or publish or upload or display to others using Candlemonk will be referred to as “Your Content.” By using Candlemonk, you acknowledge and agree that, Your Content may be viewed by the general public. You own and retain your rights to any content you draft or publish or post on Candlemonk.
By submitting or publishing or posting or displaying Your Content on Candlemonk, you grant Candlemonk a nonexclusive, royalty-free, worldwide, fully paid, sub-licensable and irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your content in association with the operation or use of Candlemonk or the promotion, advertising or marketing of Candlemonk in any and all media (including external social networking or social media platforms like Facebook, Instagram, Linkedin, etc.) or distribution methods now known or later developed.
You may draft, publish, edit, de-publish or delete your blogs or write-ups at any time. We may not be able to control deletion or removal of your content distributed on platforms outside ofCandlemonk. Candlemonk takes into consideration reports on your content raised by fellow users and may take necessary action. Your content will be subject to period checks for spam, plagiarism or reuse etc. and we may take action accordingly. This includes deletion or de-publishing of the associated content or blog or write-up. If found or decided necessary, we may suspend or terminate the associated user account.
You acknowledge and agree that Candlemonk may store and preserve your content and may disclose the same if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to comply with legal process, applicable laws or government requests or to enforce these terms and conditions or to respond to claims that any of your content violates the rights of third parties or to detect, prevent, or otherwise address fraud, security or technical issues or to protect the rights, property, or personal safety of Candlemonk, its users, or the public.
In order for Candlemonk to deliver its services, you agree that we may process, transfer and store information about you in India and other countries, where you may not have the same rights and protections as you do under local law.
You also grant us the authority to act as your non-exclusive agent to take action against any third parties indulging in unauthorized use of any of your content outside of Candlemonk or in violation of our terms and conditions.
You will, as permitted by applicable law, indemnify, defend and hold harmless Candlemonk, its directors, officers, employees, agents and partners from and against any claims like losses, liabilities, claims, demands, damages, expenses or costs arising out of or related to your violation, or infringement of any rights of another individual or entity including their intellectual property rights or privacy rights. You agree to immediately notify Candlemonk of any third-party claims, cooperate with Candlemonk in defending such claims and pay all fees, costs and expenses associated with defending such claims including attorneys’ fees.
By publishing or posting your content on Candlemonk, you represent and warrant to us that you have the ownership rights, or you have obtained all necessary licenses or permissions to use your content and grant us the rights to use your content as indicate in this agreement, and that publishing or posting your content violates no intellectual property or personal right of others or any applicable law or regulation, including any laws or regulations requiring disclosure that you have been compensated for your content. You accept full responsibility and ownership for avoiding infringement of the intellectual property or personal rights of others or violation of laws and regulations in connection with your content. You agree to pay all royalties, and fees owed to any person by reason of your content.
We would like to solve your concerns without requiring a formal legal case. Before filing a claim against Candlemonk, you agree to reach or contact us in an attempt to resolve the claim informally by sending your claim notice with details by email to contact@candlemonk.com. The details must include your name, email address, phone number and residence address, must explain the nature and basis of your claim and must set forth the specific solution or action you are expecting from us. Notices from our side will be sent to the email address linked to your Candlemonk account and will contain the same information mentioned. In cases where the parties can’t resolve the matters within sixty (60) days after any notice is sent, either party may initiate a formal proceeding.
We might be making changes to these Terms and Conditions often. Upon doing so, we would be keeping you posted on the same by sending a notification email to the email address linked to your account or by notification within the Candlemonk platform or by updating the date of publishing of the revised Terms and Conditions. Unless said otherwise in our revised notice, the updated Terms and Conditions will be effective immediately, and by continuing to use Candlemonk you consent to agree to the changes. If you don’t agree to the revised Terms and Conditions, you must stop using Candlemonk right away.
If any provision or part of a provision of these Terms and Conditions is unlawful, void or unenforceable, the same is considered severable from these Terms and Conditions and does not impact the validity and enforceability of any remaining provisions.
All communications and transactions between you and Candlemonk must be conducted electronically.
Candlemonk may include native or third party advertisements on any page you see or use and we take efforts to make them relevant to you in most cases, based on your use of the Candlemonk platform. You agree that Candlemonk and its third-party providers and partners may place such advertisements in any page of Candlemonk including pages containing the content you published.
Pages in Candlemonk platform may include forms or links to other websites or third-party products or services. You consent to be responsible for all risk arising out of your use of such websites or products or services or platforms.
Candlemonk disclaims all liability for and gives no assurance with respect to any content published by any user of Candlemonk or a third party; any third-party website or product or service you see or accessible to you via Candlemonk; the quality or behaviour of any user of Candlemonk or third party you come across in connection with your use of Candlemonk; unauthorized access, use or alteration of your content. Candlemonk gives no guarantee or warranty that it will meet your expectations or requirements or that the platform will be uninterrupted, safe, secure, timely, or error-free or that the information you may get from your use of Candlemonk or any other user will be correct or trustworthy or that the quality of any product or service or information you acquired or purchased through Candlemonk will be satisfactory.
Candlemonk disclaims any representation or warranty that Candlemonk complies with all applicable laws and regulations outside of India. If you use the Candlemonk outside of India, you understand and agree that you are responsible for determining compliance with different laws, regulations, or customs that may apply in connection with your use of Candlemonk.
